This Privacy Policy describes the policies of DK Consulting regarding the information we collect or receive about our customers. It is applicable to the dk-consulting.app website and other interactive features, applications or services that are operated by the DK Consulting and which are available through the websites produced and maintained by us (“Website”). We have established this security and privacy policy (“Privacy Policy”) to let you know the kinds of personal information we may gather, why we gather your information, what we use your personal information for, when we might disclose your personal information, and how you can manage your personal information.

1. What personal data do we process?
1.1. What data we process depends on purpose and legal basis for processing.
1.1.1. When you visit our website, connect to our services, contact us, use our software, or subscribe to your newsletter, we collect a variety of information, including your email address, device information, IP address, and a record of your communication.
1.1.2. Depending on features you use, the application may request access to notifications, calendars, reminders, files, contacts, or other device capabilities.
1.1.3. Some application data may be stored locally on your device. Locally stored data is generally not accessible to us and may be removed when the application is uninstalled, subject to your device and backup settings.
1.1.4. We may use Apple services, including iCloud synchronization and Apple CloudKit, to synchronize user data across devices.
1.1.5. We do not independently collect diagnostic, crash, or analytics data. Such data may be collected directly by Apple in accordance with your device privacy settings and Apple's own Privacy Policy, if you have consented to share analytics with Apple.
1.1.6. We use cookies, local storage, and similar technologies to operate our website and applications, maintain security, remember user preferences, and improve functionality and performance.

2. For what purposes do we process your personal data and on what legal basis?
2.1. We collect and process all your personal data in accordance with the relevant data protection regulations, in particular the General Data Protection Regulation (GDPR).
2.1.1. The personal information we collect allows us to keep you up to date on our latest product announcements, software updates, and services. You may at any time opt out of receiving such communications by contacting us. In particular, we only send you our newsletter with your prior consent, and you can opt out of receiving the newsletter anytime by clicking the unsubscribe link we include in each newsletter, or by contacting us. We do not sell, barter, or rent your personal information.
2.1.2. We also use the personal information we collect to help us create, develop, deliver, protect, and improve our products, services, content, and customer communications.
2.1.3. We may use your personal information to send important notices, such as communications about changes to our terms, conditions, and policies. As this information is important to your interaction with DK Consulting, you may not opt out of receiving these communications.
2.1.4. We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.
2.1.5. Some features of our applications and services may use automated processing and artificial intelligence technologies, including services provided by OpenAI, to generate content, assist users, automate workflows, and improve user experience. AI-generated responses and content may occasionally be inaccurate, incomplete, or inappropriate and should not be relied upon as professional, legal, financial, medical, or other professional advice. Users are responsible for reviewing and verifying important information generated through such features.
2.1.6. Our applications may collect and process information required for App Store distribution, licensing, subscription management, and in-app purchase functionality.
2.1.7. Payments and subscriptions are processed by Apple and are subject to Apple’s own terms and privacy policies.
2.2. The legal basis for processing of your personal data is one of the following:
2.2.1. The performance of a contract to which you are a party/contact person or in order to take steps at your request prior to entering into a contract: processing of your personal data is necessary to fulfill our obligations under the contract or for the conclusion of the contract.
2.2.2. Compliance with a legal obligation to which we are subject: for example, providing information to state or law enforcement bodies.
2.2.3. A legitimate business interest that is not overridden by your interests, rights and freedoms: we have the right to process your personal data if such processing lies within the scope of our legitimate interests in the course of business activity and/or is necessary for continuation of its conducting, provided that such processing does not violate your rights, freedoms and interests.
2.3. Where none of the above applies, we will ask for your consent to process data. At any time you can revoke your consent by contacting us at support@dk.ua.
3. Disclosure to Third Parties
3.1. We don’t share personal information with anyone outside of DK Consulting, except for the few exceptions below.
3.1.1. We work together with other companies who provide information processing services. We only share personal information with these companies if you have agreed to the transfer, or if it is permitted by data protection law. The information we share is limited to the data necessary for the third parties to provide their services. We use these companies for the following services: hosting of our website and support portal, providing our help desk software, sending out newsletters, analyzing our website traffic, hosting cloud services, payment processing, subscription management, and providing artificial intelligence and automation services. These companies are obligated to protect your information in accordance with data protection law and provide the necessary safeguards if they are outside of the EU. The companies are bound by our instructions and are not allowed to use the shared data for any other purpose.
3.1.2. We may use artificial intelligence services provided by OpenAI, including ChatGPT and related APIs available through the OpenAI platform, to assist in providing smart features, automation, content generation, task processing, and user support within our applications. Information submitted through our services may be processed by OpenAI in accordance with their applicable privacy and security practices. We do not sell or share your personal data for advertising purposes. AI-generated content may be inaccurate or incomplete and should not be relied upon as professional advice.
3.1.3. We may use third-party service providers and subprocessors, including cloud infrastructure, payment, and artificial intelligence providers such as Apple CloudKit, OpenAI, to support and improve our applications and services. A list of subprocessors may be provided upon request.
3.1.4. Where personal data is transferred outside the European Economic Area (EEA), we implement appropriate safeguards in accordance with applicable data protection laws, including the use of Standard Contractual Clauses where required.
4. How do we protect your personal data?
4.1. We implement appropriate technical and organizational security measures, including secure infrastructure, access controls, and encryption where appropriate, to protect personal data against unauthorized access, disclosure, alteration, or destruction.
4.2. Within the DK Consulting group, a system of policies, procedures and training on data security and privacy operates.
5. How long will your personal data be kept?
5.1. We retain personal information for as long as reasonably necessary to provide our services, comply with legal obligations, resolve disputes, enforce agreements, and maintain security and operational integrity.
6. What rights do you have?
6.1. You may have the following rights in respect of your personal data that we process:
6.1.1. Request us to give you access to your personal data;
6.1.2. Request us to rectify/update your personal data;
6.1.3. Request us to erase your personal data (“right to be forgotten”);
6.1.4. Request us to restrict our using your personal data (in certain circumstances);
6.1.5. Object to our processing your personal data (in certain circumstances);
6.1.6. Data portability (in certain circumstances).
6.2. At your request concerning the access to personal data, we will provide you with information:
6.2.1. Whether or not we process data about you;
6.2.2. The purpose of the processing;
6.2.3. The categories of data concerned;
6.2.4. The categories of persons with whom we share the data (if we did it);
6.2.5. The source of the data, if we did not collect it from you;
6.2.6. The term of personal data storage or the criteria for determining the period for which we will store the data (if the exact period cannot be established).
6.3. At your request we will provide you with a copy of the data we process.
6.4. The request to rectify or update your data applies if the data we process is inaccurate or incomplete.
6.5. The request to erase your data applies if:
6.5.1. The data we hold is no longer necessary in relation to the purposes fixed in Chapter II;
6.5.2. We process the data on the basis of your consent and you withdraw your consent;
6.5.3. We process the data on the basis of legitimate interest that overrides your rights, Interests and freedoms;
6.5.4. The data was unlawfully obtained.
6.6. Restriction of processing applies, temporarily. For example, you contest the accuracy of the data or have objections to our processing on the basis of legitimate interest etc.
6.7. You can object to our processing of your data giving an explanation of your particular situation, and we will consider your objection.
6.8. The portability of data applies if the processing is carried out by automated means.

6.10. Our applications do not require account registration and do not store user accounts.
6.11. Our applications and services are not intended for children under the age of 16, and we do not knowingly collect personal data from children.
6.12. You also have the right to lodge a complaint with your local data protection authority if you believe your privacy rights have been violated.
7. Making Amendments to Privacy Policy
7.1. We may from time to time modify this Privacy Policy. Whenever we make changes, we will indicate the date of the new edition.
